HTA COMMERCIAL ARBITRATION CENTER LAUNCHED
HTA Commercial Arbitration Center successfully held the Opening Ceremony on Saturday morning, July 6, 2019, in the cool weather, fresh air, and refreshing green scenery of Quang Trung Software City. The ceremony took place in a neat, harmonious and intimate atmosphere.
Attending the ceremony were guests who were representatives of the Supreme People’s Court, Mr. Bui Ngoc Hoa, former Deputy Chief Justice of the Supreme People’s Court; representative of HCMC People’s Court, Chief Justice of the Economic Court Mrs. Nguyen Thi Thuy Dung; Representative of Ho Chi Minh City Department of Justice, Mr. Phan Thanh Tung; Deputy Chief of Office of Justice Support Department, Mr. Phan Thanh Huy Duc; representative of HCMC Commercial Arbitration Association, member of the Executive Committee, Prof. Dr. Bui Xuan Hai; Lawyer Bui Quang Nghiem, Vice Chairman of Pacific International Commercial Arbitration Center; Mr. Ho Quynh Hung, Vice Chairman of Vietnam Consumer Goods Development Association, together with all the Founders, Arbitrators, and Mediators of the Center.
The President of the Center, Prof. Dr. Phan Huy Hong gave the opening speech, announcing the launch of HTA Commercial Arbitration Center, introducing the vision and mission of the Center, emphasizing the companion of the commercial dispute resolution by Arbitration and the dispute settlement activities by Court in order to create justice faith in the Vietnamese business community, as well as the Court’s support in dispute settlement activities by Arbitration.
Next, Judge of the Supreme People’s Court Bui Ngoc Hoa had a speech, sharing his views on the role of the commercial dispute resolving by Arbitration and Mediation in relation to the dispute resolving by Court, and his trust in the increasing contribution of non-court dispute resolution in jointly creating a safe and transparent legal environment for business activity in Vietnam.
Judge Nguyen Thi Thuy Dung, Chief Justice of the Economic Court of Ho Chi Minh City People’s Court had a speech about the supporting role of HCMC People’s Court for dispute resolution by Arbitration, such as registering ad-hoc arbitral awards, appointing Arbitrators, applying interim measures…. She also stated that from 2005 until now, Ho Chi Minh City People’s Court only accepted to review more than 100 requests on cancelling the arbitral award and among that, only about 10% were accepted, that rate also gradually decreased in recent years; proving that the quality of dispute resolution by arbitration was very good and continued to improve, as well as the arbitral award got increasing respect from the Court.
Mr. Phan Thanh Tung, Deputy Chief of Office of Justice Support Department, HCMC Department of Justice, informed the operational status of commercial arbitration centers in Ho Chi Minh City, the Department’s interest in arbitration activities, the cooperation of arbitration centers in Ho Chi Minh City with the Department of Justice in disseminating law in general, and the method of dispute settlement by arbitration and mediation in particular.
Prof. Dr. Bui Xuan Hai, Member of the Executive Board of HCMC Commercial Arbitration Association (HCCAA), Arbitrator of Vietnam International Arbitration Centre (VIAC), shared his vision on the role of dispute settlement by arbitration, his experience as an Arbitrator of VIAC and his participation in resolving over 50 disputes initiated at the largest and most prestigious arbitration center in Vietnam. He also expressed confidence in the rapid development of HTA Commercial Arbitration Center thanks to the team of expertised, experienced and socially prestigious Arbitrators of the Center.
Lawyer Bui Quang Nghiem, Executive Director of Nghiem & Chinh Law Partnership, Vice Chairman of Pacific International Commercial Arbitration Center, shared his views on Arbitrator’s professional ethics. According to his opinion, Arbitrators’ independence, impartiality and objectivity are the bases for establishing business trust in the dispute settlement by arbitration and mediation. He also expressed his confidence in the development of HTA Commercial Arbitration Center considering the presence of a highly qualified, experienced and socially prestigious arbitrator team, as well as the dedicated and professional Executive Board of the Center.
Guests, Arbitrators and members of the Excutive Board of the Center also had warm exchanges and took pictures together as part of the Opening Ceremony.
